Yes, we are independent contractors (in California) however moving to employment due to a new law. My contract stated something like “The Independent contractor, if found by law to have should have been employed, will pay all the back employment (employer and employee) taxes for up to three years” Or something like this!!! Ouch!
This is ABSOLUTELY me paraphrasing… but basically they wanted me as an IC and be risk free from IRS. I ran it by the CEO and he was shocked and took it out, stating that I should not be held responsible. However, if compliance had pushed it through without me noticing, it would be all on me.
